Domestic arbitration is a flexible, efficient and confidential method of dispute resolution between companies or individuals from the same country. The parties agree that the decision of an impartial arbitrator or a panel of arbitrators will be final and binding.

Arbitration is a form of dispute resolution to resolve disputes outside the courts. The dispute is decided by a single arbitrator or a panel of three arbitrators which renders an arbitral award. An arbitral award is legally binding on both sides and enforceable in South African courts.

Arbitration is often used for the resolution of commercial disputes where unnecessary delays cannot not be afforded. The typical business contract in South Africa now almost always provides that in the event of a dispute, the parties will resolve their differences in accordance with AFSA’s rules and procedures.
