Disputes and Related Processes
Examine the different types of disputes that arise in the workplace — including dismissals, unfair labour practices, and disputes of right or interest — and the appropriate resolution mechanisms such as conciliation, mediation, and arbitration.
The Law concerning Typical Issues for Mediation/Conciliation
Explore the legal principles that underpin common issues dealt with in mediation and conciliation, such as unfair dismissal, workplace conflict, and conditions of employment. This session equips participants to understand and apply the law while fostering collaborative problem-solving.
The Law concerning Typical Issues for Arbitration
Focus on the substantive and procedural legal rules relevant to arbitration of labour disputes. Topics include evidence, burden of proof, legal remedies, and award writing — with emphasis on fairness, compliance, and enforceability in labour arbitration settings.
CONDITIONS
Dida Masenye is an experienced and qualified professional with over 20 years of expertise in labour law, dispute resolution, and forensic investigations. He holds a BComm in Management from the University of South Africa (UNISA), a National Diploma in Alternative Dispute Resolutions from the University of Pretoria and AFSA, as well as several postgraduate diplomas in Labour Law and the Drafting and Interpretation of Contracts from the University of Johannesburg (UJ). Additionally, Dida is accredited as a facilitator in training.
He has been serving as a part-time Commissioner at the Commission for Conciliation, Mediation and Arbitration (CCMA) since 2014, where he applies his in-depth knowledge of labour law to resolve disputes and promote fair practices. Dida is also a panellist at several bargaining councils, including the Bargaining Council for the Civil and Engineering Industry, the Road Freight Bargaining Council, the Transnet Bargaining Council, and Tokiso. His extensive experience includes chairing disciplinary enquiries, conducting conciliations, mediations, and arbitrations, as well as drafting key employment documents such as contracts, grievance policies, disciplinary codes, and absenteeism policies.
In addition to his career in dispute resolution, Dida is a court-appointed mediator by the Minister of Justice and Correctional Services. He is also a qualified forensic investigator, specialising in criminal justice and forensic investigations, with a Higher Certificate in this field from UJ. Furthermore, Dida is a certified Section 189 facilitator and has a strong background in handling matters of mutual interests and organisational rights.
Dida’s diverse skill set, combined with his commitment to training and facilitating dispute resolution processes, makes him a highly regarded professional in the field of alternative dispute resolution and labour law.
